House Bill 38 is a dangerous bill that would undermine the independence of the Judicial Branch in Pennsylvania.

This bill changes how we elect judges to the Pennsylvania Supreme Court, Commonwealth Court and Superior Court. Instead of electing judges statewide, we would elect them in districts created by the General Assembly.

This would allow legislators to give one or another party an advantage in winning judicial elections.

This opens our courts up to partisan power grabs, and undue and harmful legislative influence.

Because Appellate court judges are supposed to interpret state law, their decisions affect people statewide. That's why they should be elected statewide.

Because HB 38 is a constitutional amendment, the process of passing it is different than typical legislation. To become law, Constitutional amendments like HB 38:

  • Must pass two sessions in a row

Pennsylvania lawmakers already passed HB 38 for the first-time last session (it was known as HB 196 then), which means it only needs to pass once more to go on the ballot this May.

  • Must go before voters as a ballot initiative

 

  • To get on the ballot for the May primary, the bill must pass the House and the Senate by Feb. 18.

 

  • Can NOT be vetoed by the Governor
