Discipline Procedures Different for Lawyers and Judges

An article in the Harrisburg Patriot-News discusses discrepancies between the handling of disciplinary charges brought against judges and lawyers in Pennsylvania. Charges of misconduct brought against lawyers are handled by the Pennsylvania Supreme Court Office of Disciplinary Counsel and charges of misconduct brought against judges are handled by the Judicial Conduct Board.  Charges of misconduct against judges are confidential if and until the Judicial Conduct Board files formal charges in the Court of Judicial Discipline.  According to PMC’s Deputy Director Shira Goodman, “The Judicial Conduct Board has recently gotten much more active in sending out those [press] releases. Until they are going to prosecute the judge, that is all confidential.  It’s to protect the complainant, and it’s to protect the judge from unfounded complaints.”
