Orie Melvin's Appeal

July 6, 2012

According to Beaver County Times, Justice Orie Melvin’s preliminary hearing, scheduled for July 9, 2012, has been delayed until July 30, 2012.

It was previously delayed to hear a Motion to recuse other county judges from hearing her case.  The Legal Intelligencer (subscription required) reported that Judge Jeffrey Manning had refused to grant Orie Melvin’s motion to recuse.  Patrick Casey, Orie Melvin’s attorney, argued that recusal was needed because a key witness, Lisa Sasinoski, is married to an Allegheny County Judge.  Judge Manning explained that the judge assigned to the case has the authority to decide his/her own recusal.

The Tribune Review and Post Gazette are now reporting that Orie Melvin has requested the state Supreme Court use King’s Bench powers to reverse the denial of the recusal motion.
